IRS Abuse Report #650

SP, @comcast.net, 4/7/03

I have done NOTHING illegal. All I have done was filed head of household and claimed my 2 children for 2000.i received my money for that yr.2001 is a dif. story. I did everything the same as on the 2000 return but this time they wanted to audit me for 2000. They said I couldn't file head or claim my children. I showed paternity papers, deed on house, birth and social cards, but that wasn't good enough for them. They still said they wanna audit me. Now I just received a letter from IRS stating if I don’t pay than I can lose my house and other wages. These people are really heartless. I have 3 children in my house now and they are threatening to take my home away from us…HEARTBROKEN.

I went through a divorce in 1998 and was awarded my home. However, 3 months before my divorce was final, the IRS placed a Federal Tax Lien on MY property owed by my ex-husband. He was ordered to pay off the lien of approx. $15,000.00 in the divorce. To make a VERY LONG,DISTRESSING, STRESSFUL, EMOTIONAL story short.....I have had 3 attorneys, 7 court dates, numerous missed days from work, high blood pressure, bouts with depression and migraine headaches. My ex-husband claimed BANKRUPTCY to protect him!!! The lien is now in excess of $27,000.00 on MY HOME (it was deeded to me with a court order that he was to pay OFF the lien). I work for a state agency and pay my taxes as I always have. I have NEVER had a tax problem. My ex-husband was self-employed and NEVER paid taxes. The IRS tells me I have no tax liability, so they cannot discuss the case with me. Yet, the lien remains in on MY house. The IRS stated that I do not qualify for “Innocent Spouse” because I don’t have a debt with them and did not file a return with my ex-husband. I work and pay my taxes...why am I liable for his taxes? I cannot sell or refinance my house. He owes more on the tax lien than I owe on my home. We are both remarried. My husband and I would like to sell and build a home of our own, but can’t. My ex-husband lives “High on the Hog” and this does not bother him. Why is he protected? Why can’t I be released of this lien? Why won’t the IRS take information from me regarding his address, employer...etc? He won’t even pay his child support and is protected under bankruptcy. The IRS has almost DESTROYED me!!!! It is so unfair that the IRS would protect a NON-Tax PAYING citizen , yet they want to come after me!!!! Why? I am at the end of my rope and “KNOW” that the IRS should go after the guilty…not the innocent.

I am fortunate in the fact that I do not have any children or a spouse that I would leave behind-- therefore-- blowing my brains out on a stack of IRS levy notices, certified letters, and other documents of financial ruin can only help this class action suit, especially since I have no prior record of mental instability. In fact, if I'm to be another casualty of "the agency's", where shall I have the attorney who'll be handling my estate have the blood-drenched artifacts sent? BTW, I'll be sure to place the documents on top of a full-size American flag before I pull the trigger. Is there anyone out there brave enough to fly it in the face of ongress?

Following my divorce I was suppose to claim my son as a deduction and my wife was to claim our daughter. After 3 years, I got a letter from the IRS informing me that I owed money since my wife had claimed both my son and daughter. I tried fighting but ended up agreeing to pay them $100 a month until the debt was paid. Later, I quit making payments due to health problems and costs. Once I got my disability, I tried to reinstate the payments but was told I now had to pay $150 a month. Recently, due to further health problems and costs, I was unable to pay for another three months -- the IRS then came in and completely emptied my bank account. I have paid the IRS for almost 8 years and the balance is almost the same as when I started due to their interest charges. I will now probably lose the room I rent, since the IRS stole what little bit of money I had. They don't care if someone lives in a box or under a bridge. They are ruthless and have no feelings.

In 1994 the IRS sent me a letter stating I did not file my 90 taxes, which I did. After many attempts to correct this I was told I would have to pay over two thousand dollars in back taxes - even though I really only owed only $91 to begin with. In 95 my home burned down and I foolishly I contacted the IRS and asked for an extension of my taxes (this was in March). The woman I spoke to kept asking me "Did you lose all your receipts and files" and I said "Yes, I did". Two weeks later, I was audited for all previous years. I have paid the IRS over $3,000 and now with interest and penalties it's $18,000!! I have been diagnosed with two rare diseases putting me on permanent disability. Still, I managed to get a loan to pay off the IRS.
But, at the last minute the IRS put a lien against my property, so the bank declined the loan since I no longer had collateral. I called the IRS for six straight months pleading for them to release the property so I could pay them ALL their money. To date, the IRS not only left the lien on, but added a second lien to my property. Not one person wanted to work with me nor were they interested in getting their money. There is no way out of this.

I was audited in 94/95 for no apparent reason. My combined income was about $60K, which is a low-income for this expensive area (California bay area). My employer moved me here from the east coast to work as process engineer in the area of minerals/metals in a Sunnyvale, CA lab. The employer moved out of the area in 1993, so I have been since working on/off as chemist/ chemical engineer. My wife got a city job with a low pay (about $40k/yr). So I was trying to get work as self-employed in 94/95. The auditor refused some expenses that I claimed as self-employed. As you know the penalties plus interests can add up quickly. I never agreed on the audit results, and I never could pay the bill. The current tax bill is about $40–50K (94/95/97). In the mean time I hired a tax-enrolled agent to try to solve the problem but he did not do much and I ended up losing $1,000. In 1999/2000 I submitted an offer-in-compromise but the IRS refused. I appealed but was refused again. In 2001 I was working as an Information Systems Engineer and the IRS said that our combined income was high. Since September/11/2001 I have been out of job. The IRS has always harassed me saying they are going to levy assets, garnish wages, etc. I have only bills (owe credit card, owe car loan, and owe my son’s student loan). My last harassment letter (computer generated) came last week (5/10/03). I called the IRS and there are not many choices for me. So I told them that I am going to submit another offer-in-compromise (OIC) to avoid a salary garnishment (the IRS employee said that she would garnish my wife’s salary!!!). I thought that after the IRS shakedown in 1998 the IRS would have change its attitude to a more customer-oriented organization but it does not look like it. I have also talked with the people’s advocate, but was surprised to see that they do not help the taxpayers at all. Sincerely JC
